GENERAL CONDITIONS OF SALE

 

Do you wish to place an order on the website www.lagrandeepicerie.com (hereinafter the "Site")? Please read the General Conditions of Sale, which you agree to accept when confirming your order.

ARTICLE 1 - PURPOSE - ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
1.1 These general conditions of sale define:

- The sales procedures on the website www.lagrandeepicerie.com (hereinafter referred to as the "Site") selling the products distributed by La Grande Épicerie de Paris (hereinafter referred to as the "Products"), as well as the rights and obligations of the parties arising from the online sale.

The Site La Grande Épicerie de Paris is referred to as the "Site". SEGEP products are collectively referred to as the "Products". These General Conditions of Sale are entered into between an individual or a legal entity wishing to make a purchase for their strictly personal use via the Site (hereinafter referred to as the "Customer") and the Société d'Exploitation de La Grande Épicerie de Paris (SEGEP) whose complete contact information is as follows:

By placing an order for a Product on the Site, the Customer acknowledges:
- that he/she has full legal capacity;
- that his/her order is governed by these General Conditions of Sale, the terms of which the Customer agrees to accept without restriction or reservation. Any order signifies acceptance, without reservation, of these General Conditions of Sale. This acceptance shall not be conditional upon a handwritten signature by the Customer under any circumstances. In accordance with the applicable provisions of the Civil Code, it should be noted that the confirmation of the purchase order as specified in Article 3, represents an electronic signature that has the same validity between the Parties as a handwritten signature.

Any special condition or any other written document, particularly those contained in documents issued by the Customer (including the order) cannot prevail over these General Conditions of Sale without the prior express written agreement of La Grande Épicerie de Paris.

La Grande Épicerie de Paris reserves the right to modify these General Conditions of Sale, which the Customer is responsible for reviewing on a regular basis.

The online version of the General Conditions of Sale on the Site shall, where applicable, prevail over any other version of the said General Conditions of Sale, with the exception of modifications that may be made after a Customer order, in accordance with common law.

ARTICLE 2 - PRODUCTS
2.1 Presentation and description of the Products

La Grande Épicerie de Paris presents various Products on the Site, which it offers for sale, as well as their detailed descriptions contained in the product sheets, giving the Customer the chance to learn, before the final purchase order, about the main features of each Product that he/she may buy on the Site, in accordance with the provisions of Article L.111-1 of the Consumer Code.

The information given in each product sheet, as well as their photographs, shall be those communicated to La Grande Épicerie de Paris by its suppliers. The Customers are thus informed that La Grande Épicerie de Paris may update these product sheets at any time.

La Grande Épicerie de Paris shall endeavour to ensure that the presentation of the Products whose photographs are displayed on the Site are faithful to the original Products.

Nevertheless, in light of how the Products are presented on the Internet, it is possible that the Customer's impression of the photographic representation of the Products does not exactly match the product itself.

The Products comply with current French legislation.

2.2 Product Availability

2.2.1. The products are offered subject to available stock at the time the order is made by the Customer. A Product that becomes unavailable will be indicated as such. It should be noted that La Grande Épicerie de Paris will make every effort to ensure that its entire range of offered Products is available.
La Grande Épicerie de Paris reserves the right at all times to modify or stop selling the Products offered on the Site, although such modifications will not affect the orders that La Grande Épicerie de Paris may have accepted before these modifications come into effect.

2.2.2. If a Product is unavailable, La Grande Épicerie de Paris will inform the Customer as soon as possible by email that only part of his/her order will be delivered or that his/her order has been cancelled.

In the case of a partial order, the invoice for the order shall be updated in line with the products shipped. Payment shall be taken on dispatch of the order.

2.3 Product Prices

The prices that apply shall be those indicated on the Site when the Customer confirms his/her order.
The prices are indicated in euros and shall be deemed as inclusive of all taxes. The prices are subject to French Value Added Tax (VAT) applicable on the day of the order.

The Customer is informed that delivery costs will be invoiced in addition to the price of the Products, and for this purpose will be specifically indicated on the order summary and in the order confirmation email.
La Grande Épicerie de Paris reserves the right at any time and without prior notice to modify its Product prices, without these modifications affecting the orders that La Grande Épicerie de Paris may have accepted before these modifications come into effect.

ARTICLE 3 - ORDER PROCESS AND CONDITIONS OF PAYMENT FOR THE PRODUCTS
3.1 Ordering a Product

3.1.1 To place an order on the Site, the Customer must:
- Be an adult to place any order for alcohol
- Have the legal capacity to enter into contracts
- Have an address in one of the countries to which delivery is made.
- Hold a bank account with sufficient funds enabling him/her to make an online payment for the amount of his/her order

To add a Product to his/her basket, the Customer must click on the icon "Add to basket".

At any time, the Customer may:
- obtain a summary of the Products that he/she has chosen or edit his/her basket by clicking on the "Basket" icon, which can be accessed from any page
- confirm his/her basket by clicking on "Order".


3.1.2 Once the basket has been confirmed, the Customer must identify himself/herself.

In particular, the Customer agrees to indicate:
- his/her surname(s), first name(s), telephone number and email address. Said email address must be fully valid and working.
- a postal address to which delivery can be made during business hours from Monday to Saturday.

The information requested when an order is made is necessary so that La Grande Épicerie de Paris can confirm the order(s) with the Customer and send it to him/her.

3.1.3 Once the Customer has been identified, an order summary will bring together all of the information related to that order.

3.1.4 After reviewing the summary of his/her order, the Customer will be asked:

- to click on the "Continue" button to proceed with the payment of his/her order;
And then to tick the box "I have read and accepted the General Conditions of Sale and the General Terms of Use". - or to click on the button "Return to previous step" so as to modify the details of his/her order and/or the information related to his/her personal contact information.

3.1.5 In order to make the payment, the Customer is asked to click on "Confirm my purchase" and will be asked to proceed with the payment by entering his/her bank details.

3.1.6 The data entered for delivery and invoicing by La Grande Épicerie de Paris represents proof of all the transactions made between La Grande Épicerie de Paris and the Customer. In the case of a dispute by the Parties concerning a transaction made on the Site, the data recorded by La Grande Épicerie de Paris shall be considered as irrefutable proof of the contents of the transaction. The purchase orders and invoices shall be archived on a reliable and durable medium that can be produced for the purpose of proof.

3.2 Payment of the order

The payment will be made in euros by bank card only (debit cards, Visa, Mastercard, American Express), to the exclusion of all other means of payment. The Customer's bank account shall be debited at the time of dispatch.

In order to proceed with the payment due, the Customer must provide his/her bank card number, expiry date and, where applicable, the card security code.

The Customer will be asked for his/her bank details each time he/she places an order. In addition, the payment may be validated after entry of a 3D Secure code provided by the bank of the Customer who holds the bank card and sent by SMS message.

For this purpose, the Customer warrants to La Grande Épicerie de Paris that he/she is properly authorised to use the means of payment chosen when confirming his/her order.

If declined by the bank, the order will be cancelled automatically and the Customer will be informed by La Grande Épicerie de Paris.

La Grande Épicerie de Paris uses a payment service provider and therefore does not have access to confidential information related to the Customer's means of payment at any time.

3.3 Secure payment transactions and means of payment

As part of the fight against fraud on the Internet, the information related to the Customer Order may be transmitted to any third party authorised by law or designated by La Grande Épicerie de Paris for the sole purpose of verifying the Customer's identity, the validity of the Order, the means of payment used and the planned delivery.
Following this check, La Grande Épicerie de Paris reserves the right to request a photocopy of the Customer's ID card and/or any information related to the Customer's identity. All Customers shall have the right to access, correct and remove personal data concerning them and processed by La Grande Épicerie de Paris, under the conditions set out in the "Personal Data and Cookies" policy.

All transactions shall be made on the Site by secure means. La Grande Épicerie de Paris uses an SSL protocol for this purpose. The information provided when placing the order will not be stored on the servers of La Grande Épicerie de Paris.

3.4 Confirmation of the order by La Grande Épicerie de Paris.

3.4.1 The Product order will not be considered firm and final until it has been confirmed by La Grande Épicerie de Paris. Once the Product order has been confirmed and its payment has been validated, a summary of the Customer's order, which can be printed and saved, shall be displayed stating the order reference numbers.

3.4.2 An order confirmation email will then be sent to the Customer and will contain the following information: - the order number; - the order summary (designation of the Product(s) ordered, quantity, price and basic features); - the rights and statutory guarantees to which the Customer is entitled; - the total amount of the order, inclusive of all taxes; - the delivery costs; - payment confirmation; - the terms and conditions for exercising the right of withdrawal in accordance with the provisions of Articles L.221-18 of the Consumer Code et seq.; - the terms pertaining to the delivery of the Products ordered (expected delivery time, which cannot exceed fifteen (15) days from validation of the order).

3.4.3 In accordance with the provisions of Article L.122-1 of the Consumer Code, La Grande Épicerie de Paris shall be entitled to refuse any abnormal order, any order made in bad faith, or any order unpaid due to the fraudulent use of a bank card.

ARTICLE 4 - DELIVERY AND RECEIPT OF THE ORDER

La Grande Épicerie de Paris shall retain ownership of the Products ordered until full payment of the respective price.

4.1 Livraison chez le Client

The Products will be delivered to the postal address entered by the Customer when placing his/her order and which will appear on the delivery note.

The Products ordered by the Customer on La Grande Épicerie's Site will be delivered exclusively in Metropolitan France, including Corsica, Monaco, Germany, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Spain, Estonia, Finland, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Czech Republic, Romania, the United Kingdom, Slovakia, Slovenia and Sweden.

The Customer can track the progress of his/her order delivery via a hyperlink sent to him/her when the dispatch of his/her order is confirmed, enabling him/her to access an Internet page.

To find out about the delivery charges and times offered by our carriers, please read the information stated in Article 4.2 below.

4.2 Delivery rates and zone
Zone 1: Metropolitan France and Monaco

STANDARD DELIVERY (Colissimo) - Monday to Saturday

Expected delivery time from receipt of the order: 4 days
Delivery rate: €6.50 - free delivery on purchases above €75 in the same order (not including delivery charge)

EXPRESS DELIVERY (Chronopost) - Monday to Saturday

Expected delivery time from receipt of the order: 3 days
Delivery rate: €9.50
Zone 2: Europe

Chronopost DELIVERY - Monday to Friday

Expected delivery time from receipt of the order: from 3 buisness days.
Delivery rate: €14

Certain Products (such as water) require specific delivery charges. The Customer will be informed of the exact amount of these just before confirmation of his/her order.

Since delivery is provided by a third-party provider, the Customer acknowledges and accepts that La Grande Épicerie de Paris cannot be held liable in any way if the non-performance or improper performance of this obligation is attributable to the Customer, a third party to the contract or a case of force majeure.
4.3 Product delivery times

Delivery will be made no later than thirty (30) days after the Product order up to the use-by date, unless stated otherwise, of which the Customer will be informed before his/her order is made, indicating an average delivery period.

4.4 Late deliveries

The Customer must notify La Grande Épicerie de Paris as promptly as possible of any late deliveries, whereupon the latter shall investigate the matter with the carriers concerned. The Customer shall have the right to cancel his/her order if the delivery of this order has not taken place by the delivery date initially indicated to the Customer, as long as such delay is not attributable to the Customer or a case of force majeure.

As of the exercise of the right of cancellation, or the conclusions of the investigation carried out by La Grande Épicerie de Paris confirming the loss of the package, La Grande Épicerie de Paris shall issue a refund to the bank account that was debited at the time of the order within a period of up to fourteen (14) days from receipt of the cancellation, to the exclusion of any other compensation, or shall re-dispatch the Products at its own cost if the order has not been cancelled by the Customer.

In the case of partial delivery of the order, the delivery may be made in several parts, and this right shall only relate to the part of the order not delivered.

4.5 Receipt of the Products by the Customer

Each delivery shall be deemed completed from provision of the Products at the Customer's premises by the carrier, recorded by the tracking system used by the carrier. No dispute related to the delivery itself will be possible if the package is shown as delivered, with the carrier's computer system being considered as evidence.

Without prejudice to the periods available to the Customer as part of his/her right of cancellation as specified in Article 5 above, the Customer shall be responsible for:
• Unpacking the packages in the presence of the deliverer, and
• Writing any detailed handwritten reservations on the Delivery Note. The reservations noted by the recipient on delivery represent proof of the existence and extent of the damage. The Customer should be precise and complete in his/her writing (simply stating "subject to unpacking" is considered too general and vague), and
• Submitting a reasoned letter of complaint to your carrier by registered letter with acknowledgement of receipt within three (3) days of receipt, in accordance with the provisions of Article L.133-3 of the Commercial Code),
• Informing La Grande Épicerie de Paris, by email or registered letter, within three (3) business days of delivery of the Order.
Any reservation of this type must also be notified to the Customer Service Department of La Grande Épicerie de Paris, whose contact information is given on the Site, within the same time limit and in the same form. In this regard, the Customer shall take care to attach to its letter a copy of his/her complaint addressed to the carrier.

ARTICLE 5 - THE CUSTOMER'S RIGHT OF CANCELLATION
5.1 Products of La Grande Épicerie de Paris

The customer is informed and acknowledges and accepts that La Grande Épicerie de Paris distributes wines, spirits and champagnes and accessories specific to these types of products, foods up to the best-before date and perishable foods up to the use-by date.

As regards Products of La Grande Épicerie de Paris that fall within the category of perishable foods ordered on the Site, in accordance with the provisions of Article L.221-18 of the Consumer Code, and subject to the assumptions envisaged in Article L.121-21-8.4 of the said Code, the Customer shall not be entitled to the right of cancellation established in Article L.121-21 of the Consumer Code.

However, in the case of any wines, spirits, champagnes and accessories included among the Products, the Customer shall have a cooling-off period of fourteen (14) clear days in accordance with Article L221-18 of the Consumer Code, as of the date of receipt of the order, in which to return them to La Grande Épicerie de Paris, provided that the said items are returned undamaged, in their original packaging and unopened.
The Customer must fill out the cancellation form, which can be downloaded here, and send it by email to the following address: serviceinternet@la-grande-epicerie.fr. Upon receipt, the Web Customer Service of La Grande Épicerie de Paris shall acknowledge receipt of this request by return email.
The Customer shall attach a copy of the invoice to his/her package, as well as a copy of the cancellation form that he/she previously sent to the Web Customer Service of La Grande Épicerie de Paris.
Under these conditions, La Grande Épicerie de Paris agrees to refund the Customer for the amount of the Products returned, as well as the amount of the initial delivery costs (up to the limit of the standard delivery costs), to the bank account debited at the time of the order, within a period of up to fourteen (14) days from receipt of the said La Grande Épicerie de Paris Products concerned. This sum will be refunded on receipt of the returned Products.

If the right of cancellation is exercised after the aforementioned Products have left the warehouses of La Grande Épicerie de Paris, the Customer shall be responsible for paying the return costs.

5.2 Limits and exclusions of the right of cancellation

Any Product returned incomplete, spoiled, used, washed, damaged, deteriorated, soiled or consumed, even partially, will not be refunded. Similarly, the Customer may be considered liable in the case of devaluation of the Products due to handling other than that which is necessary to determine the nature, basic features and proper functioning of the Products.

Finally, in accordance with Article L.221-28 of the Consumer Code, the Customer may not exercise the right of cancellation for:
- Products made up according to the Customer's specifications or customised at his/her request;
- Products that, due to their nature, cannot be re-dispatched or are likely to deteriorate or perish rapidly;
- Products that have been unsealed by the Customer after delivery and Products that cannot be re-sent for reasons of hygiene or health protection.

ARTICLE 6 - STATUTORY GUARANTEES

La Grande Épicerie de Paris shall respectively warrant that La Grande Épicerie de Paris Products are in conformity with the use expected of them, and do not present any defects or hidden faults rendering them dangerous or unfit for their normal use. Thus, all products on sale on the Site shall benefit from a statutory guarantee of conformity (as defined in Articles L217-4 et seq. of the Consumer Code) and a guarantee against hidden faults (as defined in Articles 1641 et seq. of the Civil Code), enabling the Customer to send the defective or non-conforming products back at no charge.

6.1. Legal guarantee of conformity

Article L.217-4 of the Consumer Code provides that "the vendor is obliged to deliver goods in conformity with the contract and shall be liable for any conformity defects existing at the time of delivery. It shall also be responsible for defects of conformity resulting from packaging, assembly or installation instructions where this has been entrusted to it under the contract or performed under its responsibility". Article L217-5 of the Consumer Code stipulates that: "The goods conform to the contract:
1. If it is suitable for the use habitually expected of similar goods and, if applicable: - if it matches the description given by the vendor and has the qualities that the vendor presented to the buyer in the form of a sample or model; - if it has the qualities that a buyer may legitimately expect based on the public statements made by the vendor, the manufacturer or his/her representative, particularly in advertising or labelling;

2. Or if it presents the characteristics established by the parties by mutual agreement or is suitable for any special use required by the buyer, made known to the vendor and which the latter accepted." Article L217-12 of the Consumer Code stipulates that "the action resulting from the defect of conformity shall lapse two years after delivery of the goods".

6.2. Guarantee against hidden faults

Article 1641 of the Civil Code stipulates that "the vendor shall comply with the guarantee against hidden defects of sold goods that render it unfit for its intended use, or that impair this use to such an extent that the buyer would not have purchased it or would have paid a lower price for it, if he/she had known about such defects". Article 1648 of the Civil Code stipulates that "action resulting from latent defects must be initiated by the buyer within a period of two years from discovery of the defect. In the case provided for in Article 1642-1, the action must be brought, under penalty of lapse of rights, in the year following the date on which the vendor can be discharged from its liability for visible faults or defects of conformity".

6.3. Exclusion of guarantees

Products that have been modified, repaired, integrated or added by the Customer are excluded from guarantee. The guarantee shall not cover visible faults. The guarantee shall not cover products damaged during transport or as a result of improper use.

6.4. Procedures for implementing the statutory guarantees

In the case of a statutory guarantee of conformity, the Customer:
- must take action within a period of two years from delivery of the goods;
- may choose to have the goods repaired or replaced subject to the conditions on costs established by Article L217-9 of the Consumer Code;
- is exempt from having to provide proof of the existence of the defect of conformity of the goods in the six months following delivery of the goods.

The statutory guarantee of conformity is applied independently of the commercial guarantee that may be provided.
The Customer may decide to invoke the guarantee against hidden defects of the sold goods pursuant to Article 1641 of the Civil Code. In this case, he/she may choose between the termination of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.


For any questions concerning the statutory guarantees, the Customer must contact Customer Service by email: serviceinternet@la-grande-epicerie.fr. These provisions do not exclude the right of cancellation defined in Article 5 above.


6.5. Consequence of invoking the guarantees

As part of the statutory guarantee of conformity, La Grande Épicerie de Paris agrees, at the discretion of the Customer:
- to replace the Product with an identical one subject to available stock,
- or refund the price of the Product, within a period of up to thirty days, if it is not possible to replace a product.
As part of the statutory guarantee for hidden defects, La Grande Épicerie de Paris agrees, at the discretion of the Customer, following assessment of the defect:
- to refund the full price of the returned product within a period of up to thirty days,
- or to refund part of the price of the product within a period of up to thirty days, if the Customer decides to keep the product.

ARTICLE 7 - COMMERCIAL GUARANTEES
7.1. Right to return

If a non-conforming Product is received, and subject to the provisions of Article 5.2, the Customer is authorised to return the non-conforming Product to La Grande Épicerie de Paris within thirty (30) days of receipt of the Product.

In this regard, it should be noted that La Grande Épicerie de Paris will not accept packages sent freight collect, and that the Product must be returned in its original wrapping and packaging. The Customer shall attach a copy of the invoice to his/her package, as well as the return slip transmitted by the Customer Services Department, which he/she previously requested by email: serviceinternet@la-grande-epicerie.fr. La Grande Épicerie de Paris will inspect the Product for the non-conformity and, if this is confirmed, a refund will be issued to the Customer automatically.
This refund will be made into the bank account debited at the time of the Product order within thirty (30) days of receipt of the non-conforming Product by La Grande Épicerie de Paris. This refund will also include the refund of the initial delivery costs if all of the delivered Products are returned. If the order is not returned in full, the initial delivery costs will not be refunded.

All risks linked to the return of the Product shall remain the responsibility of the Customer.

7.2. Right of exchange

If a non-conforming Product is received, and subject to the provisions of Article 5.2, the Customer is authorised to exchange the non-conforming Product with La Grande Épicerie de Paris within thirty (30) days of receipt of the Product concerned. For orders of La Grande Épicerie de Paris Products and to the exclusion of all foods, except where it is found that the said food has an expiry date prior to the delivery date of the Product when it is received by the Customer, the Customer must take the Product considered non-conforming and the respective web invoice to the Warehouse Reception of La Grande Épicerie de Paris located at 38 rue de Sèvres.

The Customer may also return the Product to be exchanged by post after obtaining a return slip by contacting the Internet Customer Services Department by email: relationsclientelegep@la-grande-epicerie.fr

La Grande Épicerie de Paris will inspect the Product for the non-conformity and, if this is confirmed, will proceed with the exchange.

ARTICLE 8 - RESPONSIBILITY OF LA GRANDE ÉPICERIE DE PARIS

La Grande Épicerie de Paris cannot be held responsible for any problems or damage pertaining to the use of the Internet, particularly a service disruption, the occurrence of bugs, an external intrusion or the presence of a computer virus.
Without prejudice to the provisions of the previous paragraphs, La Grande Épicerie de Paris cannot, under these General Conditions of Sale, be held responsible on any joint and several basis, and such responsibility cannot exceed a sum equal to the sums paid or payable during the transaction at the origin of the said responsibility for La Grande Épicerie de Paris products on the part of La Grande Épicerie de Paris, regardless of the cause or form of the action concerned.

ARTICLE 9 - INTELLECTUAL PROPERTY
2.1 Copyright

The Site is the whole property of La Grande Épicerie de Paris. The latter is the holder of the intellectual property rights necessary to place them online.

Both the general structure of the Site (graphic design) and its content (text, slogans, graphics, images, sound, videos), including software, databases and newsletters (hereinafter, the "Content") are the property of La Grande Épicerie de Paris or third parties authorised to use them, and are protected by copyright. The latter do not grant any licences or rights other than to visit the Site. The reproduction of all or part of the Site and its Content is authorised only for the exclusive purposes of information for personal and private use.

Therefore, pursuant to the provisions of the Intellectual Property Code, any representation, reproduction, modification and/or distortion of the Content, by means of any process and on any medium, without the prior, express authorisation of La Grande Épicerie de Paris, is prohibited and constitutes an infringement of copyright.

Similarly, the User shall be subject to criminal and civil liability for any unauthorised exploitation of the Site and/or its Content on the basis of copyright infringement.

2.3 Hyperlinks

La Grande Épicerie de Paris cannot be held liable for the hyperlinks implemented on the Site leading to other sites, and generally to any resources existing on the Internet.

Any creation of links to the Site, any framing of the Site, and more generally any use of the Content, shall be subject to the prior, express authorisation of La Grande Épicerie de Paris, which may be withdrawn at any time at its sole discretion. La Grande Épicerie de Paris reserves the right to request the removal of any link to the Site that has not been or is no longer authorised, and to request compensation for the damages suffered as a result.

ARTICLE 10 - INFORMATION TECHNOLOGY AND FREEDOMS

La Grande Épicerie de Paris collects the Customer's personal data and, where applicable, those of the Order recipient. The Customer is informed that such automated information processing has been declared to the CNIL (Commission nationale de l’informatique et des libertés [French Data Protection Authority]). The purposes, recipients and conditions according to which La Grande Épicerie de Paris collects and processes the personal data are stated in the Site's "Privacy and Cookies Policy".

All personal data shall be subject to the provisions of law no. 78-17 of 6 January 1978, as amended. ARTICLE 11 - FORCE MAJEURE

Neither the Customer nor La Grande Épicerie de Paris can be held responsible for the total or partial non-performance of his/her obligations if such non-performance is due to unforeseeable circumstances or the occurrence of a case constituting force majeure, particularly including but not limited to floods, fire, storms, lack of raw materials, transport strikes, total or partial strikes or lock-outs, whereby these cases will be appraised in relation to applicable case law.
The party affected by such events must inform the other party as soon as possible and no later than five (5) business days after the occurrence of this event.
In this case, the Customer and La Grande Épicerie de Paris agree to come together as soon as possible to jointly determine the methods for executing the order during the case of force majeure.

ARTICLE 12 - PARTIAL INVALIDATION

If one or more of the stipulations under these General Conditions of Sale are deemed invalid or declared as such in accordance with a law or regulation, or following a final decision of a competent jurisdiction, the other stipulations shall remain in force to his/her full extent.

ARTICLE 13 - NON WAIVER

If one of the parties to these General Conditions of Sale has not demanded the enforcement of a given clause, either permanently or temporarily, this cannot be considered as a waiver of this party's rights deriving from the said clause.

ARTICLE 14 - THE ENTIRE AGREEMENT

These General Conditions of Sale, the General Terms of Use and the order summary transmitted to the Customer form a contractual whole and are the entire contractual relations maintained between the Parties.
In general, it is expressly agreed between La Grande Épicerie de Paris and the Customer that any emails, as well as the automatic recording systems used on the Site, shall be considered proof between them, particularly as regards the nature and date of the order.
The Customer may, if applicable, and in accordance with the rules of common law, access the electronic contract entered into between the Customer and La Grande Épicerie de Paris.
For this purpose, the Customer must contact the Customer Service department by email, providing all the necessary information to perform this task, particularly the order number and his/her contact information.

ARTICLE 15 - CUSTOMER SERVICE - OMBUDSMAN SERVICE

ARTICLE 16 - APPLICABLE LAW - DISPUTES

The law applicable to these General Conditions of Sale and the orders pertaining to them is French law, to the exclusion of the Vienna Convention on the International Sale of Goods.
Subject to provisions to the contrary in the code of civil procedure, any disagreement that may arise concerning the validity, interpretation or performance of these general conditions of sale, which has not been settled amicably by the parties hereto, shall be submitted to the FRENCH courts, notwithstanding multiple PARTIES, summary proceedings, or expert appraisals.
